1. Introduction & Acceptance

Welcome to Dainty Dairy LLC (“Company,” “we,” “us,” or “our”). We are a Limited Liability Company with a principal mailing address at 355 N Homestead St., Box 1973, Colorado City, AZ 86021, US. By accessing or using our website located at www.daintydairy.com (the “Site”) and any related services, tools, or functionalities (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use our Services.

These Terms govern your relationship with Dainty Dairy LLC regarding your purchase and/or use of our raw milk, dairy products, and related offerings (“Products”). By placing an order or otherwise using our Services, you acknowledge you have read, understand, and agree to these Terms.

2. Scope of Services / Offerings
We specialize in raw milk, yogurt, cheese, butter, eggs, and other dairy products. Currently:

- Local Delivery: We deliver strictly within Colorado City, AZ at no additional charge.
- Pickup Locations: We offer pickup at designated locations in Southern Utah at no additional charge.
- Regulatory Compliance: We are in the process of obtaining the relevant dairy certifications and complying with all applicable Arizona (and, where relevant, Utah) regulations.

We reserve the right to modify, suspend, or discontinue any part of the Services or Products at any time with or without notice.

3. Fees & Payment Terms
- Prices: Our Product prices are listed on our Site or communicated at the time of order. All prices are subject to change without notice.
- No Delivery/Pickup Fees: We do not charge separate fees for local delivery or pickup.
- Payment: Payment methods accepted may include credit/debit cards, cash upon pickup, or other electronic payment services.
- Refunds: We offer a full refund if the milk spoils before 7–10 days from the date of purchase or delivery, provided you have stored it as recommended (i.e., between 33–38°F in a refrigerator).
We reserve the right to deny a refund if improper storage or handling by the customer caused the spoilage.

4. No Guarantees / Disclaimers
- Raw Dairy Disclaimer: Raw (unpasteurized) milk and other raw dairy products may contain bacteria and other pathogens that can cause illness, especially in children, the elderly, pregnant women, or those with compromised immune systems. By purchasing our Products, you acknowledge and accept these risks.
- No Medical or Dietary Advice: The information presented on our Site or through our Services is for informational purposes only and is not intended as a substitute for professional medical or dietary advice.
- Storage & Shelf Life: We provide general guidelines for storage (e.g., keep refrigerated at 33–38°F). Actual shelf life may vary based on individual storage practices.
- No Warranty: The Products and Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

5. Liability Limitations & Indemnification
- Limitations of Liability: To the fullest extent permitted by law, Dainty Dairy LLC and its members, officers, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of or inability to use our Products or Services.
- Assumption of Risk: You assume all risks associated with the consumption of raw dairy products or any of the products we offer. We shall not be liable for any illnesses or adverse health effects arising from improper handling, storage, or consumption.
- Indemnification: You agree to indemnify, defend, and hold harmless Dainty Dairy LLC, its affiliates, and their respective officers, employees, and agents from any and all claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of our Services.

6. User Accounts & Security
- Account Creation: You may create an account or check out as a guest to purchase our Products. If you create an account, you are responsible for maintaining the confidentiality of your username and password.
- Information Accuracy: You agree to provide accurate, current, and complete information during signup or checkout, and to update such information if it changes.

7. Governing Law & Dispute Resolution
- Governing Law: These Terms and any dispute arising out of or relating to them or the Services will be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
- Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be resolved by binding arbitration in accordance with the rules of a recognized arbitration provider selected by us.
- Forum Selection: If arbitration is not enforceable, you agree to the exclusive jurisdiction of the state or federal courts located in Arizona.

8. Changes to Terms
We may revise or update these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.

9. Additional Provisions
- Third-Party Services: We may integrate or use third-party websites, payment processors, or other services. We do not endorse or assume responsibility for any third-party sites or services.
- Severability & Waiver: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. A failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
